Employee Free Choice Act - A Union Hoax

Attention Congress. After decades of legislation intended to make certain consumers have full information so they can make intelligent, informed purchase decisions, you are being asked by the big Labor Unions to deny that same benefit to employees who are being asked to decide whether unions are right for them. Read the Nation's labor laws. Notice that Unions are not required to tell the truth in their organizing attempts. And there is no recourse for employees who see that the promises made by unions were broken after they were voted in.Talk to people other than Union Leadership and you will find that at the point where the information is most needed, the vast majority of employees eligible to vote in the representation election have not seen the Union's constitution and by-laws, have not read the NLRB summary about elections and collective bargaining, and do not know or understand that there is no requirement for the employer or the union to agree to any proposal. The only requirement is to bargain in good faith.

Employee Free Choice Act! That is laughable. It should be called the "Full Employment and Funding for Union Leadership Act". Unions represent less than 8% of the private sector workforce. Why? Because they are outdated and spend most of their time trying to run politics. Look at what the SEIU spends on its political agenda. Same with the big teachers' unions. That is member dues money that is being spent. It might be worth a visit to www.EmployerReport.com for more insight into the real agenda at work here.

Why does a group representing such a small percentage of workers have such big clout? Money. And that is what the EFCA is all about. Take away the employees' right to full information, let them make uninformed/misinformed decisions, and fill the Union coffers with more money. Both Presidential candidates are talking about the exporting of American jobs. What do you think strikes, restrictive work rules, and erosion of accountability will do? If you said 'accelerate this loss', you are correct.

Attention employers, do you trust Congress to act in the best interest of your employees, and even your business? Has there been anything in recent history that has actually helped? I recently listened in on a webinar put on by two Partners from the highly regarded law fim McGuire Woods. (Email me and I'll provide contact information), and the effects of EFCA on our businesses is far from good.

My strong suggestion to you is to start right now assessing where you stand with your employees.

Do they feel they are being treated fairly?

How do they feel about communication?

Review your policies and procedures, your handbooks, and your compensation and benefit plans.

What kind of managers do you have? What skills are important for them to have? Do they have them?

How well does your dispute resolution process work? I would also suggest you get someone to help you with this assessment who will tell you the honest truth. This is no time to play the lead in 'The Emperor's New Clothes'. If you have a trusted HR advisor, get that person involved. And do not opt out by saying that you do not want to stir the pot; that you know your people. What if you are wrong? Fighting a union organizing drive is expensive, and we don't even have EFCA,... yet!

Attention everyone. There is a reason the unions have given hundreds of millions of dollars to get Sen. Obama and other Congressional Democrats elected. There is a reason so many union 'volunteers' are working the Democrat campaigns. How much Union money goes to Republicans? This is not a political entry, but it is a call to Congress, business leaders, and voters to see this Bill for what it is.

This is not about employee free choice. That only happens with full and honest information, and sufficient time to process that information. If this was about employee free choice then we would have a Bill holding unions accountable for the truthfulness of their campaign propaganda, and outlawing the 'card check'.

No, this is about the Unions buying the votes to get access to more dues and more companies. What this means is less productivity and more jobs going overseas. Bad legislation will get passed with a fillabuster proof majority and a rubber stamp in the White House. We ask for change, we are promised change, but is this the change we want?

Read the act, talk to people who actually know about representation elections, and then decide. But start learning now. And regardless where you come out on EFCA, now is the time to take a proactive approach to your employee climate, and fix what needs to be fixed. Act now.
